Eligibility
- Accommodation is open to all ordinary Indian Citizens above the age group of 60, whose next inheritance or close relative stays away mainly out of station or even abroad due to their occupation and wants to accommodate his / her parent / relative, or who can't run his / her life due to loneliness or in absence of any attendant / person who can take care of him / her or those who can't run their lively-hood adequately due to old age factor or those who are free from family liabilities and wish to live their remaining life & share their knowledge and experiences of life with the same generation of people. Both men and women are eligible subject to general fitness.
- Indian citizens who will bear the expenses of the license fee / other charges (if any) in his / her own capacity would be considered for admission. The local guardian / nominee is required as a guarantor on Non-judicial Stamp paper to pay the license fee / other charges (if any) on regular basis in case of inability on the part of applicant on later part of life.
- In case the applicant who is not capable to bear the expenses in his / her own capacity, the local guardian may stand as 1st Guarantor on Non-judicial Stamp paper to pay the license fee / other charges (if any) on regular basis. In case of the absence of 1st Guarantor as may be in the form of leaving of city / state / country for any reason whatsoever for any specific period or in the event of death, the 2nd Guarantor shall act as the 1st Guarantor to pay the license fees or other charges (if any) on regular basis.
- The applicant who is suffering from any communicable infectious diseases or is physically & mentally challenged or is mentally depressed or has any pending criminal cases or offences against him / her or is addicted to liquor or psychotropic substances like drugs or any type of intoxicant is not eligible for admission. This evaluation is highly reserved by the Executive Committee of the Home.
Types of Accommodations:
- Double Occupancy (AC & Non-AC): Two beds with attached bathroom & toilet preferably for couple, or brothers, brother & sister, sisters or friends or residency
- Single Room (AC & Non-AC): Single bed with attached bathroom & toilet
SECURITY DEPOSIT:
- At the time of auto renewal of Life Long Agreement: In case of auto renewal of agreement (Life Long) at the end of tenure period, i.e., 8 years, renewal will be taking place without deposit of any escalated amount of security deposit subject to consent from the resident or his / her local guardian / guarantor.
- At the Time of Renewal of Agreement: In case of renewal of agreement (one year or long term) at the end of tenure period, if the resident or his / her local guardian / guarantor agrees to renew the agreement, he / she should intimate the Executive Committee in writing 30 (thirty) days prior to the date of end of tenure. In such case no percentage shall be deducted from his / her security deposit amount except any dues payable as per schedule. The escalated amount of the security deposit prevailing at that time shall be paid by the resident / guarantor whosoever. If the letter of intent of renewal of agreement is not received by the Executive Committee as per the schedule it will be considered as End of Tenure.
- Orientation Period: During the orientation period of 3 months from the date of admission, the Home shall have the right to terminate the resident (cause of termination shall be solely reserved by the Home). In such case, the Home will refund 70% of the security deposit after deducting any dues payable as per schedule but such amount will not carry any interest.
- Self-withdrawal from the Home: In case the resident / local guardian / guarantor intends to withdraw or revoke the agreement within the agreement tenure, the resident & his / her local guardian / guarantor shall submit their intention in writing at least 30 (thirty) days prior to leaving the home. In such case, the Home will refund 70% of the security deposit after deducting any dues payable as per schedule but such amount will not carry any interest.
- End of Tenure: In case the resident wants to leave the Home at the end of tenure and he / she or the Local guardian / guarantor does not want to go for any renewal, the Home will refund 80% of the security deposit after deducting any dues payable as per schedule but such amount will not carry any interest.
- In case of Death of the resident: In case of unfortunate event of death of the resident within the tenure of agreement, the Home will refund 80% of the security deposit after deducting any dues payable as per schedule but such amount will not carry any interest to his / her nominee or the guarantor existing at that moment.
- Charges at Departure:
- In case the departure is between 1st & 15th of the month: Half month lodging fees
- In case the departure is between 16th & 31st of the month: Full month lodging fees
Death & Funeral:
- In the unfortunate event of death of any resident, the efforts will be made by the Home as soon as possible to contact his / her local guardian / guarantor over the phone and at the address available in the office record. In case the local guardian / guarantor fails to take possession of the body within further 2 (two) hours from issuing of the death certificate by the physician, the funeral rites will be performed by the Home in such a manner as may be deemed appropriate subject to the lodging of written complaint / FIR to the local Police Station. In such case, death certificate issued from the local authority shall be handed over either to senior heir (subject to proof) of the deceased resident or as per the order of the local police station.
- In case the local guardian / guarantor request to preserve the body for a certain time to prevent decomposition, the Home will make necessary arrangement to keep the body in the mortuary from where local guardian / relative / guarantor will take over the body for final rituals. The Home will provide the necessary documentations. The carrying & preservation cost at the mortuary shall be borne by the party.
- In the event of failure to contact the local guardian / guarantor due to any reason whatsoever beyond the control of the Home, the action will be taken as per the 1st clause.
- No complaint or grievance whatsoever as regards to the medical treatment or alleged negligence of any sort and/or the disposal of the body will be entertained.
Maintenance of Home Premises & Furniture:
- Rooms at the Home are well furnished and equipped with modem facilities like Bed, Mattress, Pillow & Pillow covers, Bed Linen, Top Sheet, Quilt, Curtains in windows and doors, LCD TV, Study Table, a Chair, geyser in bathroom and also a built-in Cupboard with air-conditioner (for AC Rooms).
- A resident is not allowed to change his / her room or seat, unless prior written permission from the Executive Committee is obtained for it.
- The resident shall be responsible for proper upkeep of Electronic items, furniture and fittings etc. and keep the room neat & tidy along with the premises clean, healthy and pleasant.
- Any damage, breakage or loss of any furniture or fixture including the glass panes or electric fittings due to the negligence and/or misuse by the resident or his / her guests, the cost of repair or replacement as determined by the Executive Committee will be recovered from the resident / local guardian / guarantor concerned.
- No resident shall remove any furniture or fittings from the allotted space.
- The Executive Committee is authorized to change the allotment of the room at any time at their sole discretion and the same shall bind the resident(s) and no complaint shall be entertained in this respect.
Inspection of Room:
The room will be liable to be inspected by the Executive Committee daily at any time. The Executive Committee reserves the right to access the room of residents at any time for any routine / emergency visit with a short prior intimation to the resident. For any misplaced key or any other reasons, the Executive Committee reserves the right to keep a duplicate key of the room in their safe custody.
Terms & Conditions:
- A resident is a mere Licensee and has no legal rights of exclusive possession of the room or the seat allotted to him / her.
- All residents must specify a local guardian, who can be contacted in case of any emergency or need. In case the local guardian / 1st guarantor leaves the city or the state or country for any reason whatsoever for a specific period, the local guardian / 1st Guarantor should give prior notice of minimum 30 (thirty) days to the Executive Committee with supporting documents. In such a case the 2nd Guarantor must act as the local guardian/1st Guarantor for that time being.
- In case the Local guardian / guarantors changes his / her address, or contact details, he / she should intimate the same to the Executive Committee in writing within 24 hours either through mail, obviously over phone or by visiting the Home personally.
- In case a resident becomes incompetent due to medical problem then the signature or any documentation on his / her behalf shall be undertaken by the local guardian / guarantor. In such scenario, a certificate of his / her medical condition certified by a registered medical practitioner must be furnished to the Executive Committee.
- Food comprises of Breakfast, Tea, Lunch, Tiffin, Tea and Dinner which will be served at the fixed hours only at the dining room or at the room as per the choice. No additional fees for room service will be added.
- Daily food list to be decided by the Executive Committee from time to time.
- Any resident can carry his / her mobile / tab / laptop and any charges of such mobile phone / bill shall be borne by him / her / local guardian / guarantor as the case may be. In case of any misplacement of mobile / tab / laptop, the Home shall not be responsible in any manner whatsoever.
- If any resident knowingly / unknowingly uses the mobile / tab / laptop in regard to any misappropriation of any application / sites as per the cyber law / other related laws, the Home shall not be responsible in any way if any unwanted situation arises out of such act(s).
- Any item / products / anything booked through any app of mobile / tab / laptop shall not be permissible in any nature and under no circumstances shall be allowed inside the Home.
- The resident has to leave the Home immediately on cancellation of license to stay due to default in monthly payment of the Home charges consecutively for two months or on disciplinary grounds. The Home reserves every right to dismiss any resident on disciplinary ground. The decision of the Executive Committee shall be final and binding on the resident.
- Residents are not allowed to keep pets in the Home premises.
- No residents shall be allowed to use any kind of intoxicants / drugs / cigarette / tobacco / betel chewing within the premises. No intoxicant / liquor or drugs of any kind shall be allowed to be brought in the Home premises.
- Gambling or any sort within the premises is strictly prohibited.
- No residents shall be allowed to keep fire arms or weapons with him / her inside the Home even though it has license or has any religious rituals.
- If any resident wishes to donate his / her body organs such as eyes, kidneys etc. or the body on his / her death in the Home, the same should be declared in a sound mind beforehand with the consent of his / her local guardian / guarantors so that the Home may take appropriate action in time.
- To cultivate and develop amity and unity amongst themselves, the residents are required to extend a helping hand and participate in Home activities according to their capacity & capability.
- No resident shall be allowed to run private business from the Home nor shall anyone be allowed to undertake any Govt. or Private Job.
- If any type of mishap occurs like pandemic, earthquake, flood, war the Home will provide the best endeavour to help and support the resident in such situation but will not be responsible in any manner whatsoever.
- If any disputes or differences arises in respect of the agreement the same shall be referred to the Arbitrators Ajay Kumar Chaubey, 5, Kiran Sankar Roy Road, Kolkata 700001 & Ajit Kumar Chaubey, 27/1B, Nimu Goswami Lane, Kolkata 700005.
- In any judicial matter of the court, the jurisdiction will be Kolkata only.
Visiting Hours:
Visiting hours for the Guests will be from 10:00am to 12:00 noon and 4:00pm to 6:00pm daily and on Sunday and Gazetted Holidays from 9:00am to 12:00 noon and 4:00pm to 6:00pm.
- In no cases the guests are allowed after or before the aforesaid hours. Normally the residents will entertain their Guest(s) at the lounge of the Home.
- The Home has the option of Guest House where the visitors / guests can stay against charges.
- No guest is allowed to meet the resident who is bedridden due to illness before or after the visiting hour without prior permission from the Executive Committee.
- Any resident wishing to go and stay out of the Home for a short duration may do so only after getting mutual consent from both the Executive Committee & his / her Local Guardian / guarantor. In case any miss-happening occurring during this phase the Home shall not be held responsible in any manner.
- The Executive Committee had the authority to restrict visits / visiting hours in any special circumstances / calamities / epidemics etc.
Notices:
All notices & other communications shall be in writing & in English. Any notice / information / communication may be served upon only by email or sms. The Home shall not be responsible for any information not received by the local guardian / guarantors if he / she has not given his / her updated or current e-mail I.D. / mobile no. from time to time.
Compliance with any Central, State or Local Laws:
The Resident / Local Guardian / Guarantor agrees to enter the agreement in strict compliance with the laws of the land.
Amendments of Rules & Regulations:
JIBANPUR Vanaprastha Village Trust reserves the right to make any addition to, alteration in, or deletion from the above-mentioned rules and regulations from time to time as may be deemed expedient in accordance with change in time and circumstances without any prior notice to anybody. The decision of the Executive Committee will be final & binding on the residents and the local guardian.
